What will be discussed?

  1. How and when is ‘conciliation’ as an option discussed with parties (both Complainant & Respondent)?
  2. What kind of terms can be proposed as conciliation?
  3. Discussing grey areas such as:
    • Is there a flip-side to conciliation?
    • What would you do if a party asks you about the probable terms that could be proposed as conciliation?
    • What if terms are prejudicial to a party?
    • What if terms are not feasible for the organization?
    • Does conciliation mean acceptance of guilt?
  4. Points to remember for drafting conciliation terms
  5. What happens after terms are signed? How are they implemented?
  6. Is there a difference between conciliation terms and conciliation report?
  7. What if a party wants to withdraw terms post conciliation?
  8. Templates and drafts:
    • Is there an ideal report format?
    • What are the best practices?
    • Is an agreement required? Is a note sufficient?
    • Is an undertaking required?

For point no. 8, in order to have a more focused and effective discussion, we are also inviting members of the community to share templates / formats you are using. We will analyse and compare the different formats / pointers to come up with a standard template taking into consideration the learnings of everyone. Templates can be sent to latest by 15th March 2021 to allow us some time to compare.

  • As per POSH Law and other related Regulations, Guidelines etc. – This platform is for you.


  • Connect with each other, discuss challenges faced and find / discuss practical solutions.
  • Connect with professionals, fellow colleagues and experts – to not only learn from each other but also create a strong community that supports each other and celebrates achievements.
  • Have open discussions – Especially because several provisions under law are grey and open to interpretation one way or another
  • This platform shall also be used for free discussions as well as discussing varied perspectives, experiences and opinions. In exchange, we all would need to ensure that we respect all views.


Firstly, because it’s a one of a kind initiative to (1) Ensure open discussion (2) collaborative learning (3) Support system / Community. Over and above that, for the following reasons:

  • The discussion we will have, will be recorded and published on YouTube. However, this will be available for viewing EXCLUSIVELY for Members of ‘Host & Dost’.
  • In case you are looking to conduct a session for the first time and want to take views from peers, you can present and the peers can give you constructive feedback.
  • In case you have just started conducting inquiries and need guidance, you can raise your queries in the forum. In any case, if you have any queries, those can be discussed during the meetings.
  • In case you need any government notifications or judgments to be discussed to get more clarity – this can be done too.
  • Specialised sessions can also be organized (this will be based on discussions with peers).
