Data on India’s POSH landscape

Two sides of the same problem

One report examines what is happening in India’s workplaces.
The other examines why and what it will take to change it.
The Quiet Crisis

Workplace Sexual Harassment Complaints in India

103 complaints analysed

A detailed analysis of workplace sexual harassment complaints handled by The Legal Swan in 2025, examining complainant and respondent profiles, where incidents occur, what form harassment takes, how Internal Committees respond, and what outcomes reveal about the shifting landscape of POSH in India.

The Silent Gap

POSH Awareness and Training Gaps Across India's Workforce

6,353 survey participants
A comprehensive pre-training survey of employees, students, managers, IC members, and trainers, mapping the gap between stated POSH awareness and applied understanding. The data reveals, with precision, where training is working and where it continues to fall short across India’s workplaces.

What the data reveals

Selected findings from both reports. Each figure is drawn
directly from The Legal Swan complaint analysis and pre-training survey data.

0 %
of employees were unaware that their organisation has a POSH Policy, despite the POSH Act mandating its wide dissemination. Nearly 1 in 4 employees have never seen or heard of their organisation’s policy.
0 %
of complaints involved hostile work environment harassment, and not the explicit quid pro quo scenario most associated with the POSH Act in public discourse, but the persistent comments, messages, and atmosphere that corrode dignity over time.
0 %
did not recognise abusive or vulgar language as sexual harassment. This is a direct misconception about what the POSH Act covers, with immediate consequences for what employees identify, report, and act upon.
0 %
of sexual harassment incidents occurred outside physical office premises, such as on offsites, business travel, hotels, and after-hours gatherings. Further, 25.24% of such incidents involved elements of both settings.
0 %
of employees said they would discuss an ongoing POSH complaint with colleagues, indicating a direct breach of the confidentiality obligations imposed by the POSH Act. The problem extends to management: 41.14% of managers said the same. This is one of the most consequential gaps the Report reveals, and one most likely to deter complainants from coming forward.
