Delhi Government Notification: Mandatory Establishment of Internal Committees

The Government of the National Capital Territory of Delhi has issued an order dated 06-01-2025 emphasizing compliance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013. This central legislation mandates the formation of Internal Committees (ICs) in all workplaces with 10 or more employees, aiming to ensure a safe and accessible redressal mechanism for women at work.

The notification reiterates the Supreme Court’s directions in Aureliano Fernandes v. State of Goa and Ors. (W.P. (C) No. 1224/2017) for strict implementation of the provisions of the Act. Employers are also encouraged to register on the Ministry of Women and Child Development’s She-Box portal, an online platform for filing and monitoring complaints related to sexual harassment.

Action Points for Employers:

  1. Constitute an Internal Committee (IC): Ensure your organization has a functional IC as mandated under Section 4 of the Act.
  2. She-Box Registration: Public and private sector employers are encouraged to register themselves on the She-Box portal to enhance transparency and access to the complaint resolution mechanism.
  3. Sensitization and Reporting: Employers should stay informed about compliance requirements through their respective District Labour Officers and ensure timely submission of relevant information.

Non-compliance with the Act will attract penalties as stipulated by the Law. Employers are urged to prioritize compliance to foster a safer and more equitable workplace environment.
